Dear Congressman:
I am referring to a letter of June 29, 2015 addressed to the Hon. John F. Kerry, US Secretary of State regarding US support for the restitution of Jewish communal, private, and heirless property confiscated by the Nazis and their collaborators during the Holocaust era between 1933-1945. This letter calls for legislation to be enacted by Central and Eastern European countries, among them Poland, Croatia, Hungary, Latvia, Lithuania, Romania and Serbia to provide fair and responsible restitution, return and compensation to the victims and their heirs for property confiscated during the war. I understand that 46 US Congressmen signed this letter and that you are one of its supporters. I attach a copy of this letter for your reference. This letter improperly addresses its demands on the government of Poland and is without legal basis not supported by historical facts.
Poland was attacked and invaded by Nazi-Germany and the Soviet Union in September, 1939 partitioning the country and starting World War II. During the period of 1939-1945 both Nazi-Germany and the Soviet Union looted, destroyed and confiscated private and communal property and various other assets not only owned by the Jewish population of Poland, but also of Polish citizens and its residents. In addition millions of Poles were killed- murdered, executed, deported, left homeless, starved, etc. as a result of the war. Poland also suffered loss to its culture and economy after the war as the Soviet troops advanced and occupied the country after 1945 to 1989. In total there were at least 3 million Poles killed by the Nazi-German occupation and at least 3 million Poles killed by the Soviet occupation. As stated before private property was confiscated, looted, destroyed, etc. without any compensation or even any hope for return, reimbursement or compensation to the rightful owners. During the war the local population was being terrorized not only by the Nazi and Soviet army, but also by their respective Secret service-police known as Gestapo and the NKVD. All of the killing-executions-murders, destruction-looting and confiscation of property was done pursuant to orders directly from the Nazi Gestapo and the Soviet NKVD, later known as KGB. Polish government established in exile and the Polish Underground army fought and opposed the Nazi-German – Soviet occupation of their country. Poland established armed forces that fought the Nazis along with the Allied forces of US, Great Britain and France. Polish army participated and assisted in the liberation of concentration camps where thousands of Poles had died. As a result of Teheran and Yalta Conferences Poland along with other countries of Central and Eastern Europe were betrayed by the Allies (USA, Great Britain, France) and were occupied by the Soviet Union and had to continue under a Communist system until 1989-90. Throughout that time thousands of Poles were killed- murdered, executed, tortured, while their property was being confiscated, looted, destroyed, etc. by the communist authorities.
The letter to Secretary John F. Kerry calls for compensation, restitution and return of confiscated property by Poland and other Eastern European countries to prior owners. However it is called for restitution, compensation and return of property refers only to the Jewish owners. Nothing is said about restitution, return and compensation of the Polish citizens. Nevertheless, in 1960 the Polish-Communist government agreed to return property and compensate the Jewish victims for their loss of property. It was agreed to pay 40 million dollars as payment in full for all demands by the victims of Jewish descent for their loss as a result of confiscation during the Holocaust period. This agreement was made even though Poland is not responsible for World War II and did not collaborate with Nazi-Germany. Germany agreed to pay compensation, restitution and even returned property to its prior owners after the war. In fact it is still being paid. Germany definitely committed war crimes and is being held responsible. However the former Soviet Union, even though numerous war crimes were committed by the NKVD has not been held responsible. Millions of Russians, Ukrainians, Byelorussians, Lithuanians, Latvians, Estonians, POLES, etc. were killed, murdered, executed, etc. by the NKVD-KGB under the Soviet-Communist system. They also had their property looted, destroyed, confiscated, etc. To this day very few, at most were compensated and no restitution was made.
It’s restitution not reparations. Poland is not liable for German crimes and the Polish state, which was completely overrun by Nazi Germany and the Soviet Union was not in control of the territory, is not liable for crimes of any individual collaborators. If such collaborators did exist, they should be held liable under existing law. Restitution is not payment for torture or suffering, but compensation for property that was nationalized by the Polish state after the war under the direction of the Soviet authorities, mainly NKVD-KGB. Nowadays, former owners can try to reclaim their property, but they have to do it individually. It’s complicated (though not impossible). Jewish organizations and other governments call for simplified procedures. More controversial is the idea that Poland should provide compensations for ALL Jewish property, independently of whether heirs survived or not (if not, which is usually the case, the money would go to Jewish organizations). Restitution is also an issue for a number of non-Jewish Poles who are trying to reclaim properties nationalized by communists.
Therefore, for the reasons above stated I do not think that this letter to Secretary Kerry has any basis and should be rescinded. In addition Poland is now a sovereign and independent country with a democratically elected government. It is irresponsible for the US to seek influence and try to enforce another “agreement” to pay restitution while same has been already paid in full many years ago. I request that you review this issue in view of the above and contact me regarding the same as soon as possible. I am willing to meet with you and discuss this problem in person. Please advise me as soon as possible.
